Terms of Service

Introduction

Please read these Terms of Service (“Terms”) carefully before using the Engage mobile application (“App”) operated by Max Jenkins (“We”, “Us”, “Our”).

By downloading, registering, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

I. Eligibility

1.You must be at least 16 years of age to use this App. By using the App you represent and warrant that you meet this requirement.

2.If you are under the age of 18, you confirm that you have obtained permission from a parent or legal guardian to use the App.

3.By creating an account, you represent that the information you provide is accurate, current, and complete, and that you will keep it updated.

II. Your Account

1.You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

2.You agree to notify us immediately at joinengage@gmail.com if you become aware of any unauthorised use of your account.

3.We reserve the right to suspend or terminate your account if we believe you have violated these Terms, provided false information, or engaged in behaviour harmful to other users or the App.

4.You may delete your account at any time from within the App. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

III. Use of the App

1.Engage is a personal screen time tracking and social accountability application. You agree to use it only for its intended purpose and in compliance with these Terms and all applicable laws.

You agree not to:

a.Use the App in any way that is unlawful, harmful, or fraudulent.

b.Attempt to gain unauthorised access to any part of the App or its infrastructure.

c.Reverse engineer, decompile, or disassemble any part of the App.

d.Use the App to harass, abuse, or harm other users.

e.Use automated tools or scripts to interact with the App.

f.Impersonate any other person or entity when creating an account.

3.We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

IV. Screen Time Data

1.The App uses Apple’s Screen Time API to read device usage data. You must explicitly grant permission for this access. You may revoke this permission at any time through your device settings, in which case the App’s core features will no longer be available.

2.Your screen time data is your own. We process it solely to provide the App’s features. Connections you have explicitly approved can see your daily total and streak. Your per-app times are only shown to you.

3.Screen time data shared with your connections is visible only to users you have explicitly accepted as connections. You can remove connections at any time from within the App.

V. Connections and Social Features

1.The App allows you to connect with other users to compare screen time in a shared view. All connection requests require explicit approval from the receiving user.

2.You may remove any connection at any time from within the App.

3.You are responsible for your interactions with other users. We are not liable for the conduct of any user on the App.

VI. Intellectual Property

1.The App, including its design, code, graphics, and content, is owned by Max Jenkins and is protected by applicable intellectual property laws.

2.These Terms do not grant you any right to use our name, logo, or branding in any manner.

3.You retain ownership of any content you provide to the App, including your profile information. By providing such content you grant us a limited, non-exclusive licence to use it solely to operate and improve the App.

VII. Disclaimers

1.The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

2.We do not warrant that the App will be uninterrupted, error-free, or completely secure.

3.Screen time data accuracy is dependent on Apple’s Screen Time API. We make no warranty as to the completeness or accuracy of the data provided.

VIII. Limitation of Liability

1.To the fullest extent permitted by applicable law, Max Jenkins shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

2.Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the twelve months preceding the claim. As the App is currently free of charge, this amount is zero.

3.Nothing in these Terms excludes or limits any rights you may have under applicable consumer protection law that cannot be excluded or limited by contract, including rights under Australian Consumer Law where applicable.

IX. Governing Law

1.These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

2.Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection law in your country of residence provides otherwise.

X. Changes to These Terms

1.We reserve the right to update these Terms at any time. When we do, we will notify you via the App. Continued use of the App after changes are published constitutes your acceptance of the revised Terms.

2.If you do not agree to the revised Terms, you should stop using the App and delete your account.
